1. Agreement to Terms
By accessing or using Mile 12 Warrior (the "Service"), operated by Mile 12 Warrior LLC ("we," "us," "our"), you ("you," "your," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. This site may link to or reference 1 Social Butterfly, a supportive avenue for living your best life — blogs, community, and merchandise — at 1socialbutterfly.net.
These Terms constitute a legally binding agreement between you and Mile 12 Warrior LLC. Please read them carefully before using the Service.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
We do not knowingly collect or solicit personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506. If we learn that personal information from a child under 13 has been collected, we will delete that information promptly.
California users under 18 years of age may request removal of content they have publicly posted on the Service pursuant to California Business and Professions Code § 22581. To request removal, contact us at joyce@mile12warrior.com.
3. Account Registration
To access certain features of the Service, you may be required to create an account. When registering, you agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and promptly update your account information to keep it accurate and complete;
- Maintain the security and confidentiality of your password and accept responsibility for all activities that occur under your account;
- Notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your account at our sole discretion if we determine that you have violated these Terms or engaged in conduct that is harmful to the Service, other users, or third parties.
3a. Communications & Subscriptions
You may choose to subscribe to our newsletter, blog or email updates, and forum-related communications. Subscription is voluntary. You may unsubscribe at any time, without penalty, by using the unsubscribe link in any email we send, through your account preferences where available, or by contacting us at joyce@mile12warrior.com. We collect only the information necessary to provide these communications and to operate the Service. Your rights regarding your personal information, including access, correction, deletion, and opt-out, are described in our Privacy Policy.
4. User-Generated Content
The Service may allow you to post, submit, or share content including forum posts, blog comments, and other community contributions ("User Content"). You retain ownership of your User Content; however, by submitting User Content to the Service, you grant Mile 12 Warrior LLC a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, display, distribute, reproduce, modify, and create derivative works of your User Content in connection with the operation and promotion of the Service.
You represent and warrant that your User Content:
- Is content you own or have the lawful right to use, and does not infringe any third party's copyright, trademark, or other intellectual property rights;
- Does not include material copied from books, articles, websites, or other sources unless you have permission or the use is clearly permitted by law (e.g., brief quotation with attribution);
- Does not infringe any third party's privacy or other legal rights;
- Is not defamatory, obscene, harassing, threatening, or otherwise objectionable;
- Does not contain unlawful content or encourage illegal activity;
- Does not violate any FMCSA, USDOT, or other federal or state transportation safety regulation;
- Does not contain viruses, malware, or other harmful components.
We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, without notice, for any reason, including suspected copyright infringement. We may terminate accounts of users who repeatedly post infringing or unauthorized content.
5. Prohibited Conduct
You agree not to engage in any of the following activities in connection with the Service:
- Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity;
- Harassing, bullying, intimidating, or threatening other users;
- Sending spam, unsolicited messages, or unauthorized advertising;
- Uploading or transmitting viruses, malware, or any other malicious code;
- Scraping, crawling, or using automated means to access the Service without our express written permission;
- Attempting to gain unauthorized access to any portion of the Service, other accounts, systems, or networks;
- Circumventing, disabling, or otherwise interfering with security features of the Service;
- Posting content that encourages or promotes violation of FMCSA Hours of Service (HOS) rules, safety regulations, or any other federal or state transportation law;
- Posting content that infringes any copyright, trademark, or other intellectual property right of another (including pasting articles, lyrics, long excerpts, or images you do not own or have permission to use);
- Using the Service for any purpose that is unlawful or prohibited by these Terms.
6. Intellectual Property
All original content, features, functionality, design, source code, graphics, logos, and trademarks displayed on the Service — including but not limited to "Mile 12 Warrior" — are the exclusive property of Mile 12 Warrior LLC and are protected under the United States Copyright Act (17 U.S.C.) and the Lanham Act (15 U.S.C. § 1051 et seq.). "1 Social Butterfly" is a trademark of its respective owner.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Service without our prior written consent, except as expressly permitted by these Terms or applicable law.
7. E-Commerce, Refunds & Returns
The Service may offer merchandise and other products for purchase ("Products"). Our refund and return policy is disclosed here and at points of sale in accordance with California Civil Code § 1723 and the FTC’s Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435). By placing an order, you agree to these terms.
Pricing & Availability: All prices are listed in U.S. Dollars (USD) and are subject to change without notice. All orders are subject to product availability. We reserve the right to limit quantities or discontinue products at any time.
Shipping: We currently ship to U.S. addresses only. Shipping times and costs are provided at checkout. If we cannot ship within the promised time (or within 30 days if no time was stated), we will notify you and, if you do not consent to a delay, refund you in full without being asked, in accordance with 16 CFR § 435.2.
Physical Merchandise (Apparel, Gear, and Other Shipped Goods)
- Returns: We accept returns within 30 days of delivery. Items must be in original, unused condition with tags attached where applicable. Return shipping is the responsibility of the buyer unless the return is due to our error (e.g., wrong or defective item).
- Refunds or exchanges: For eligible returns, we will issue a full refund to the original payment method or an exchange of equal value, at your choice. Refunds will be processed within 14 business days of our receipt of the returned item. For card payments, we will process the refund within seven (7) business days of when the refund is due, where required by FTC guidelines.
- Merchandise covered: This return policy applies to physical merchandise (e.g., apparel, vests, gear) sold by us. It does not apply to digital products (see below).
This policy is displayed conspicuously before purchase (e.g., in these Terms, at checkout, and via a link from our shop and footer). Under California Civil Code § 1723, a retailer that does not conspicuously display a limited return policy may be required to allow returns for a full refund within 30 days. We display our policy to comply with that requirement.
Digital Products (Course, Digital Packets, and Other Electronic Content)
Purchases of digital products — including the 90-Day Onboarding Course, digital safety packets (e.g., New Driver Packet, Seasoned Driver Packet, Fleet packets), and any other electronically delivered content — are licensed, not sold. You receive a limited, non-exclusive license to access and use the content for your personal or internal business use in accordance with these Terms.
- Personal use & devices: Your license allows you to use the content on your own devices (e.g., phone, laptop, tablet) for your personal use only. You may not share, copy, or distribute the content to others. Fleet licenses allow company-wide use and unlimited printing per company for the license period (e.g., 12 months) and are for your organization only.
- No refund after access or download: Once we have granted you access to a digital product (e.g., course access or download link), or you have downloaded or substantially used the content, we do not offer refunds except as required by law or at our sole discretion.
- Limited exception: If you request a refund within 7 days of purchase and have not yet accessed, downloaded, or substantially used the digital product, we may at our discretion issue a refund. Contact us at joyce@mile12warrior.com with your order details to request consideration.
- Revocation of access: We may revoke or suspend access to digital content if we lose distribution rights or if you breach these Terms. We will not revoke access for reasons unrelated to these Terms or our rights without providing a prorated refund where required by law.
We disclose this digital-product policy before purchase so you can make an informed decision. California law (including AB 2426, effective January 1, 2025) may require clear disclosure that digital purchases are licensed and that access can be subject to restrictions; this section satisfies that transparency.
Sales Tax: Applicable sales tax is collected as required by California law (Cal. Rev. & Tax. Code § 6051 et seq.) and the laws of other applicable jurisdictions.

8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing:
- All content on the Service is for educational and informational purposes only and does not constitute medical, legal, regulatory, or professional advice of any kind.
- Safety content is intended to align with USDOT FMCSA regulations (49 CFR Parts 350–399) and Caltrans/CALDOT (Title 13 CCR); however, regulations are subject to change. Users must independently verify current rules at fmcsa.dot.gov and dot.ca.gov.
- No professional–client, attorney–client, or doctor–patient relationship is created by your use of the Service.
- The Service may contain paid advertising or sponsored content. Such content will be clearly identified (e.g., as “Ad,” “Sponsored,” or “Paid partnership”) in accordance with FTC guidelines (16 CFR Parts 255 and 435).
- We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MILE 12 WARRIOR LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of any third party on the Service;
- Any User Content obtained from the Service;
- Unauthorized access, use, or alteration of your transmissions or content.
In no event shall Mile 12 Warrior LLC's total aggregate liability exceed the amount you have paid to us in the twelve (12) months preceding the claim giving rise to such liability.
Nothing in these Terms is intended to limit or exclude liability that cannot be limited or excluded under applicable California law, including non-waivable consumer rights.
10. Indemnification
You agree to defend, indemnify, and hold harmless Mile 12 Warrior LLC, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys' fees) arising from:
- Your use of and access to the Service;
- Your violation of any provision of these Terms;
- Your violation of any third-party right, including any intellectual property, property, or privacy right;
- Any claim that your User Content caused damage to a third party.
This defense and indemnification obligation will survive the termination of these Terms and your use of the Service.
11. DMCA / Copyright Infringement
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe that content on the Service infringes your copyright, please submit a written notification to our designated agent with the following information:
- A physical or electronic signature of the copyright owner or authorized representative;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material that is claimed to be infringing and its location on the Service;
- Your contact information (address, telephone number, email);
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Our response: We will remove or disable access to material that we believe in good faith infringes copyright, and we may terminate the accounts of users who are repeat infringers in appropriate circumstances.
Counter-Notification: If you believe your content was removed in error, you may submit a counter-notification containing: (1) your physical or electronic signature; (2) identification of the removed material and its prior location; (3) a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; and (4) your name, address, telephone number, and consent to jurisdiction of the federal court in the Eastern District of California. We will forward your counter-notification to the original complainant and restore the material within 10–14 business days unless the complainant files a court action.
12. Third-Party Links
The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Mile 12 Warrior LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.
Links to government resources such as FMCSA, Caltrans, and other regulatory agencies are provided for informational reference only and do not imply endorsement or affiliation.
You acknowledge and agree that Mile 12 Warrior LLC shall not be responsible or liable for any damage or loss caused by or in connection with the use of any third-party content, goods, or services.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles, and applicable federal law of the United States.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Sacramento County, California, in accordance with its applicable rules, except where prohibited by law. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Small Claims Exception: Notwithstanding the above, either party may bring an individual action in small claims court in Sacramento County, California, for disputes within the court's jurisdictional limits.
14. Modifications to These Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice by posting the updated Terms on the Service and updating the "Last Updated" date above. We may also notify you of material changes via email or a prominent notice on the Service.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.
15. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
